We”) respect your privacy and are committed to protecting it through our compliance with this privacy policy (“
Privacy Policy”). This Privacy Policy describes:
· The types of information we may collect or that you may provide when you download, install, register with, access, or use the FanSwipr mobile application (the “
FanSwipr App”) or FanSwipr website located at
www.fanswipr.com (the “
FanSwipr Website”), including any content, functionality and services offered on or through the FanSwipr App and FanSwipr Website, in each case whether as a guest or a registered user (the FanSwipr App and FanSwipr Website, together with any content, functionality, and services offered thereon or therein, are referred to herein as, the “
FanSwipr Platform”).
· Our practices for collecting, using, maintaining, protecting, and disclosing that information.
Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download the FanSwipr App or register with or use the FanSwipr Platform. By downloading the FanSwipr App or registering with or using the FanSwipr Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see
Changes to Our Privacy Policy). Your continued use of the FanSwipr Platform after we revise this Privacy Policy means you accept those changes, so please check the Privacy Policy periodically for updates.
Information We Collect
This Privacy Policy applies to all information collected by or submitted to the FanSwipr Platform and third parties acting on its behalf. (“
Personal Information”) is data by which you may be personally identified, such as name, postal address, email address, phone number, or any other identifier by which you may be contacted online or offline. We may also collect certain Personal Information and information about your activities while using the FanSwipr Platform, as described below.
Information You Provide to Us
When you download the FanSwipr App and register to create an account for the FanSwipr Platform, you will be required to provide us with information about yourself (the “Personal Information”). This Personal Information may include your name, postal address, email address, phone number and other information. We may also collect information that you voluntarily provide to us, such as your personal interests or product and service preferences.
This information includes:
· Information that you provide by filling in forms in the FanSwipr Platform. This includes information provided at the time of registering to use the FanSwipr Platform, subscribing to our service(s), posting material (if permitted), and requesting further services. We may also ask you for information when you enter a contest, sweepstakes, or other promotion sponsored by us, and when you report a problem with the FanSwipr Platform.
· Records and copies of your correspondence (including email addresses and phone numbers) if you contact us.
· Your responses to surveys that we might ask you to complete for research purposes.
· Details of transactions you carry out through the FanSwipr Platform and of the fulfillment of your orders.
· Your search queries on the FanSwipr Platform.
· Information that the FanSwipr Platform collects online from you and maintains in association with your account, such as your username and/or password.
You also may provide information to be published or displayed (hereinafter, “
Posted”) on public areas of the FanSwipr Platform, or transmitted to other users of the FanSwipr Platform or third parties (collectively, “
User Contributions”). Your User Contributions are Posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the FanSwipr Platform with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. If you delete your User Contributions from the FanSwipr Platform, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other FanSwipr Platform users. Proper access and use of information provided on or made available through the FanSwipr Platform is governed by the FanSwipr
Terms of Use.
Transaction Information
As an account holder, when you make a Transaction, we will collect information about your Transaction, including the date and time of the Transaction, the Transaction amount, the bet(s) placed, and the operator involved in the transaction (the “
Transaction Information”). As part of using the FanSwipr Platform, you will be given the option to link your betting accounts to your FanSwipr account. The FanSwipr Platform does not collect or obtain access to your payment information, nor does it facilitate the act of betting in any financial capacity. However, FanSwipr will route you to a legal betting operator in your jurisdiction.
Automatic Information Collection and Tracking
When you download the FanSwipr App or access and use the FanSwipr Platform, we and our service providers (which are third party companies that work on our behalf to provide and enhance the FanSwipr Platform) may use technologies to automatically collect information, including but not limited to:

Usage Details. When you access and use the FanSwipr Platform, we may automatically collect certain details of your access to and use of the FanSwipr Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the FanSwipr Platform. We may also automatically collect the search terms you use on the FanSwipr Platform, the specific web pages you visit, and the duration of your visit(s). In addition, we may collect data regarding the types of content you interact with, information derived from your Groups and your User Contributions (including other Members with whom you interact, topics you discuss with your Groups, and anything else that you post or interact with via the FanSwipr Platform) and the frequency, duration, and timing of your activities. We may combine your information with information that other people provide when they use our Platform. We use data such as this to better understand our Platform usage, so that we know which areas of our Platform users prefer.

Device and Reference Information. We may collect information about your computer or mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number. We may also automatically collect any third-party website from which your visit to the FanSwipr Platform originated, the type of browser you are using (e.g., Google Chrome, Microsoft Edge, Firefox, Safari, etc.), and the domain name of your internet service provider.

Location Information. The FanSwipr Platform collects real-time information about the location of the device from which you are accessing the FanSwipr Platform (e.g., approximate geographic location inferred from an IP address).
If you do not want us to collect this information do not download the FanSwipr App or, if you already have downloaded the FanSwipr App, delete it from your device, and do not access or use the FanSwipr Platform. Note, however, that opting out of the FanSwipr Platform’s collection of certain information will disable certain features related to such information (for example, opting out of the FanSwipr Platform’s collection of location information will disable location-based features).
Information Collection and Tracking Technologies
The technologies we use for automatic information collection may include:
· Cookies (or mobile cookies). A cookie is a small file placed on your smartphone or the hard drive of your computer. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone or computer. However, if you select this setting, you may be unable to access certain parts of the FanSwipr Platform. We utilize cookies for a few different purposes. Cookies can either be “session cookies” or “persistent cookies”. Session cookies are temporary cookies that are stored on your device for the duration of your visit to the FanSwipr Website or while using the FanSwipr Platform, whereas “persistent cookies” are stored on your device for a period of time after you leave the FanSwipr Website or after using the FanSwipr Platform. We use persistent cookies to store your account preferences so that they are available for the next visit, to keep a more accurate account of how often you visit the FanSwipr Platform, and how your use of the FanSwipr Platform varies over time.

Web Beacons. Pages of the FanSwipr Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit FanSwipr, for example, to count users who have visited those pages or opened an email and for other related app and computer statistics (for example, recording the popularity of certain app content and verifying system and server integrity).
Third-Party Information Collection
When you use the FanSwipr Platform or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:
· Advertisers, ad networks, and ad servers.
· Analytics companies.
· Your mobile or computer device manufacturer.
· Your mobile or internet service provider.
These third parties may use tracking technologies to collect information about you when you use the FanSwipr Platform. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
The FanSwipr Website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies,” which are text files placed on your computer or smartphone to help the FanSwipr Website analyze how visitors use the FanSwipr Platform. The information generated by the cookie about your use of the FanSwipr Platform (including your IP address) will be transmitted to and stored by Google. Google may use this information for the purpose of evaluating your use of the FanSwipr Platform, compiling reports on activity, and providing other services relating to activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. By using the FanSwipr Website, you acknowledge the processing of data about you by Google in the manner and for the purposes set out above. If you do not want your data being used by Google Analytics, please note that you may opt-out of having or making your FanSwipr Platform activity on the FanSwipr Website available to Google Analytics by installing the Google Analytics opt-out browser add-on provided by Google. Sharing With Third Parties
We may disclose and/or share your information under the following circumstances:

Service Providers. We may provide access to or share your information with select entities that use the information only to perform services on our behalf. These service providers provide a variety of services to us, including without limitation, processing, and delivery of mailings, providing customer support, hosting websites, processing transactions, performing statistical analysis of our services, administering of promotions, sweepstakes, surveys, providing marketing assistance or similar such services, data storage, security, fraud prevention, and other services. These companies will be permitted to obtain only the Personal Information they need to deliver the service, are required to maintain the confidentiality of the Personal Information, and are prohibited from using it for any other purpose.

Business Partners. Some services on the FanSwipr Platform may be co-branded and offered in conjunction with another company. If you register for or use such services, both the FanSwipr Platform and the other company may receive information collected as part of the co-branded services.

Direct Marketing. We may share the information with third party partners to provide you with information, including marketing, about services that we think you might want and to promote the FanSwipr Platform’s products and services to you.

Third Parties for Legal Purposes. From time to time, we may use your Personal Information: (a) if we need to respond to valid legal process, including, but not limited to, a search warrant, subpoena, or court order, and any other instance when we believe we are required to do so by law; or (b) if we deem it necessary to disclose Personal Information, in our sole discretion, to comply with any applicable law, regulation, legal process or governmental request, or to protect our rights or interests, including to enforce our
Terms of Service, this Privacy Policy, or other contracts with you, including investigation of potential violations of those agreements. We may also use or disclose Personal Information to respond to claims that any content violates the rights of third parties; and/or to protect our rights, property or personal safety, or that of our agents and affiliates, our users and/or the public. This includes exchanging information with other companies and organizations for information security, fraud protection, spam/malware prevention, and similar purposes.
Third Party Accounts Linked to Your Account on Our Platform
If you link your third-party account(s) to your FanSwipr account, then we may collect data associated with those accounts on third-party platforms and services, including your wager data (i.e. wagers placed, wager amounts, and wager types). Once linked, this data is integrated into our Platform and cannot be removed unless you individually and manually delete it or deletion is otherwise required by law.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, to:
· Provide you with the FanSwipr Platform, and any other information, products or services that you request from us.
· Fulfill any other purpose for which you provide it.
· Give you notices about your account or subscriptions.
· Send you SMS messages for purposes of authentication.
· Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
· Notify you when FanSwipr Website or FanSwipr App updates are available, and of changes to any products or services we offer or provide though the same.
· To allow you to participate in interactive features on the FanSwipr Platform.
· Solicit your feedback.
· In any other way we may describe when you provide the information.
· For any other purpose with your consent.
The usage information we collect helps us to improve the FanSwipr Platform and to deliver a better and more personalized experience by enabling us to:
· Estimate our audience size and usage patterns.
· Store information about your preferences, allowing us to customize the FanSwipr Platform according to your individual interests.
· Speed up your searches.
· Recognize you when you use the FanSwipr Platform.
We may also use your information to contact you about our own and third parties’ products and services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile.We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. If you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.
In addition, we may disclose personal information that we collect or you provide:

· To contractors, service providers, and other third parties we use to support our business.
· To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of FanSwipr’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by FanSwipr about the FanSwipr Platform users is among the assets transferred.
· To third parties to market their products or services to you if you have not opted out of these disclosures.
· For any other purpose disclosed by us when you provide the information.
We may also disclose your personal information:
· To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
· To enforce our rights arising from any contracts entered into between you and us, including the FanSwipr
Terms of Use, and for billing and collection.
· If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of FanSwipr, our users or others.
Your Choices
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. One way you can choose whether or not to allow the FanSwipr Platform to collect information through these tracking technologies is through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as allow you to decide on acceptance of each new Cookie in a variety of ways. You can also delete all Cookies that are already on your computer. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the FanSwipr Platform may then be inaccessible or not function properly. Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location by updating the settings on your mobile device. If you block the use of location information, some parts of the FanSwipr Platform may become inaccessible or not function properly.

Promotion by the Company. If you do not want us to use your email address to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to
Support@fanswipr.com.

Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an email stating your request to
Support@fanswipr.com.

Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by logging into your FanSwipr Platform account and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to
Support@fanswipr.com.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You may be able to opt out of receiving targeted ads from members of the Network Advertising Initiative (“
NAI”) at

Contests, Sweepstakes, and Other Promotions
We may, at various times, use the FanSwipr Platform to collect information for contests, sweepstakes, or other promotions. The information you enter for contests, sweepstakes, or other promotions is voluntarily submitted by you. You may also receive informative email messages as a result of your entrance unless you have chosen to opt out of receiving such messages, either at the time of sign up or in accordance with the opt-out instructions included with the informative message(s) delivered to your email inbox.
Accessing and Correcting Your Personal Information
In accordance with applicable law, you may have the right to:
· Access Information about you consistent with legal requirements. In addition, you may have the right in some cases to receive or have your electronic Information transferred to another party.
· Request correction of your Personal Information where it is inaccurate or incomplete.
· Request deletion of your Personal Information, subject to certain exceptions prescribed by law.
· Request restriction of or object to processing of your Personal Information, including the right to opt in or opt out of the sale of your Personal Information to third parties, if applicable, where such requests are permitted by law. You can review and change your personal information by logging into the FanSwipr Platform and visiting your account profile page.

We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.Proper access to and use of information provided on the FanSwipr Platform is governed by our
Terms of Use.
Transfer of Information
The FanSwipr Platform and information provided on or through the FanSwipr Platform may be stored and processed in the United States and is intended only for users located in the United States. If you are located in the European Union or elsewhere outside of the United States, please do not use the FanSwipr Platform or provide any information to us or otherwise through the FanSwipr Platform. Please be aware that information we collect will be transferred to and processed in the United States. By using the FanSwipr Platform or providing us with any information, you acknowledge any related transfer and the processing of information in the United States.
Data Storage
We store the personal information we receive as described in this Privacy Policy for as long as you use the Platform or as necessary to fulfill the purpose(s) for which it was collected, provide our services on the Platform, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
Data Security
The security of your personal information is important to us. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the FanSwipr Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the FanSwipr Platform. The information you share in public areas may be viewed by any user of the FanSwipr Platform.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure, and we cannot guarantee the security of personal or other information transmitted through the FanSwipr Platform.
Age Requirement
The FanSwipr Platform is not intended for anyone under the age of 21.
Changes to Our Privacy Policy
We may update our Privacy Policy from time to time but reserve the right to change the Privacy Policy at any time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page, update the Effective Date of this Privacy Policy, and notify you by email. By accessing the FanSwipr Platform after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes.
The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for visiting this Privacy Policy whenever you access the FanSwipr Platform to check for any changes.
